1. Acceptance and Changes

1.1 By using the Service, you confirm that you are at least 16 years of age and agree to these Terms.

1.2 We may update these Terms at any time. Material changes will be communicated within the Service or on donstreamo.com. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 Don Streamo is a media player available as an app for iOS and tvOS. It lets you add your own sources, scans them for video files, enriches them with metadata from the internet (see Section 7), and plays them back on your device.

2.2 Don Streamo is provided completely free of charge. There are no user accounts, no subscriptions, no in-app purchases, and no advertising (see Section 6).

2.3 Don Streamo is a player only. It is not a content provider and supplies no media of its own. It does not provide tax, legal, or other professional advice.

3. Your Media and Lawful Use

3.1 Don Streamo does not host, provide, supply, or distribute any media content, and it contains no media library of its own. All media you access through the App comes exclusively from sources you add and control — your local files, your network shares, your media servers, or your own cloud storage.

3.2 You are solely responsible for the media you access through the App and for ensuring that you own it or are otherwise legally entitled to access and play it. You must not use the App to access, store, stream, or play any content in violation of copyright or any other applicable law.

3.3 We have no knowledge of, access to, or control over the content of your sources, and we accept no responsibility for it. The legality of the content you connect is entirely your responsibility.

3.4 The metadata enrichment feature retrieves information about commercially released titles from TMDB (see Section 7). This metadata is descriptive only and grants you no rights to any content.

4. Device Identifier and No Account

4.1 No sign-up or login is required. When you first open Don Streamo, a random 25-character identifier is automatically generated and stored on your device. It is used solely for anonymous analytics as described in our Privacy Policy; it is not an account and contains no personal information by itself.

4.2 The access details you enter for your own sources (server addresses, usernames, passwords, or tokens) are stored locally on your device and are never transmitted to our servers. You are responsible for keeping these credentials confidential.

5. Acceptable Use

5.1 You agree to use the Service only for lawful purposes. The following actions are prohibited:

• Reverse-engineering, decompiling, or modifying any part of the Service or its API, except to the extent such restriction is prohibited by mandatory applicable law.
• Accessing our backend API by any means other than the official App.
• Attempting to circumvent request signing, the version gate, or any other security measure.
• Using the Service to infringe the rights of any third party or to violate applicable law, including the use described in Section 3.2.

5.2 We may suspend or discontinue your access if you violate these Terms.

6. No Fees

6.1 Don Streamo is provided completely free of charge. There are no subscriptions, no in-app purchases, no paywalled features, and no advertising.

6.2 Should we introduce optional paid features in the future, they will be clearly marked as such before any purchase, and these Terms will be updated accordingly. You will never be charged without your explicit, prior consent.

7. Third-Party Services

7.1 TMDB. The App retrieves metadata (posters, cast, plot summaries, ratings) from The Movie Database (TMDB). Your use of TMDB data is subject to TMDB's terms. Don Streamo uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.

7.2 Your sources. Any network share, media server, or cloud service you connect to the App is operated by you or by a third party of your choosing under separate terms. We are not responsible for the availability, content, or legality of those sources.

7.3 App Store. The App is distributed via the Apple App Store, whose terms apply to your download and use of the App (see Section 14).

8. Availability and Modifications

We strive to keep the Service available but cannot guarantee uninterrupted access. Unavoidable events such as maintenance, outages, or attacks may lead to temporary unavailability. Because Don Streamo is local-first, the App continues to play your media on your device even when our backend is unavailable. We reserve the right to modify, suspend, or discontinue the Service or any feature at any time.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Don Streamo does not warrant that the Service will be error-free or uninterrupted, or that every file format, codec, or source will play correctly, as playback depends on your files, your sources, and your network. Don Streamo does not verify the content, accuracy, or legality of media accessed through your sources.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Don Streamo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to access, the Service, including but not limited to loss of data. As the Service is provided free of charge, our total liability is limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits our liability for intent, gross negligence, injury to life, body, or health, or any liability that cannot be excluded under mandatory law. For EU consumers: these limitations do not affect statutory rights you may have under the consumer protection laws of your country of residence.

11. Intellectual Property

The Service, including its design, code, branding, and content created by us, is owned by Don Streamo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission. TMDB and all other trademarks mentioned in the Service are the property of their respective owners.

12. Termination

12.1 You may stop using the Service at any time. Deleting the App removes the local identifier and the source credentials stored on your device.

12.2 We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We may also remove or anonymize inactive anonymous analytics records.

12.3 We may terminate or suspend your access for violation of these Terms. Upon termination, your right to use the Service ends immediately.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG). Disputes shall be resolved in the courts of Cologne, Germany.

For EU consumers: You retain all rights under the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory consumer rights.

14. App Store Distribution — Additional Terms

If you obtained the App through the Apple App Store, you acknowledge the following:

• These Terms are between you and Don Streamo only, not with Apple Inc.
• Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance, support, or warranties for the App.
• Apple is not responsible for any product liability claims, legal compliance issues, or consumer protection claims relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
• Your use of the App must comply with the Apple App Store Terms of Service.
